Pois bem, depois de contada um pouco da história do movimento do Direito Alternativo no Brasil e no mundo, vamos agora falar um pouco de sua teoria, seus princípios e fundamentos básicos.
Como medida propedêutica, acho interessante começarmos falando aquilo que o Direito Alternativo não é, para melhor entendimento da matéria.
O Direito Alternativo não é uma cópia de outros movimentos, como pode se perceber ao analisarmos seus princípios.
O movimento nada tem a ver com o fundamentalismo islâmico, como diz Gilberto Callado de Oliveira, em seu livro " A verdadeira Face do Direito Alternativo: 4ª Edição - Revista e Atualizada com Estudo da Influência do Gramscismo no Direito Alternativo, página 65. Inclusive o referido autor demonstra uma total falta de ética cientifica, ao dizer que o movimento do Direito Alternativo se assemelha com grupos terroristas como o Resboláh e o Sendero Luminoso.
Não é meta do Direito Alternativo a extinção das Leis para instauração de um Estado anarquista no Brasil, pois, é unanime a todos alternativistas, que as leis escritas são conquistas da sociedade, e por pior que elas sejam, pelos menos existem, pois a vida em sociedade sem leis não daria certo, pois os homens passaria a ser por demais descricionários.
