É fato que o Direito Alternativo é um movimento que não se restringe ao Brasil, pelo fato de não ter se iniciado aqui e sim te ter migrado para o Brasil após aproximadamente 40 anos de existência na Europa.
Mais precisamente o Direito Alternativo surgiu na Itália por volta de de 1964.
No período da Ditadura de Mussolini, estava proibida qualquer tipo de organização.
Com o fim da era fascista começaram a surgir as primeiras organizaões de juristas italianos, entre eles a M.D. - Magistratura Democrática, grupo de Juízes de Esquerda, que tinha como ponto em comum a ruptura com a ideologia Iluminista.
A M.D. teve duas etapas:
de 1964-1968: Assumiu uma postura mais liberal-democrática, utilizando a Constituição como fonte maior de Direito.
de 1968 - 1969: onde assumiram uma postura mais socialista (aproximando-se do marxismo), sendo a primenra vez na história que um grupo de juristas se declarava então, contrário a classe dominante, ou seja, a burguesia.
Após anos de discussão, no anode 1972 surgiu o movimento então denominado de "Uso Alternativo do Direito", como proposta efetuadas em reunião de juristas, realizada na Catânia, Itália em maio de 1972. A intenção maior desse grupo de magistrados era fazer uma reapropriação social da função normativa.
